Why do you need a Marriage Certificate Apostille?
A marriage certificate apostille is the legal verification that proves your marriage is genuine and recognized by the Indian Government to a foreign entity. It is mandatory for Hague Convention member countries when applying for:
- Dependent Visas or Family Reunion Visas.
- Adding a spouse to health insurance or job benefits abroad.
- Filing for joint citizenship or permanent residency.
- Buying property jointly in a foreign country.
The Authentication Process
A marriage certificate is classified as a personal document. Therefore, the legalization process bypasses the HRD and goes through the Home Department or SDM.
- Notarization: Initial verification by a local Notary Public affirming the document's basic validity.
- State Home Department OR SDM Attestation: The document is submitted to the Home Department of the issuing state OR the Sub-Divisional Magistrate (SDM) in New Delhi. (We highly recommend SDM attestation for significantly faster processing).
- MEA Apostille: The Ministry of External Affairs (MEA) verifies the signature/seal of the SDM or Home Department and affixes the final, legally binding Apostille sticker on the reverse side of the original certificate.
Important Note on "Panchayat" Certificates
The MEA does NOT apostille marriage certificates issued casually by a local Panchayat or religious institution (like a temple or mosque receipt) unless they are formally registered under the Hindu Marriage Act or Special Marriage Act with the Registrar of Marriages. You must have a computerized, official Registrar certificate.
Required Documents for Submission
- Original Marriage Certificate: The physical original copy issued by the Registrar of Marriages.
- Passport Copies: Clear copies of the front and back pages of both the husband's and wife's passports.
